Delivery conditions and acquisition of goods
The ordered goods are delivered to the location specified in the order. The transport of the goods to this location is arranged by the seller and paid for by the buyer. Upon receiving the goods, the buyer is obligated to check the condition of the package.
Any damaged shipment must be immediately reported to the seller, and a damage report must also be completed with the carrier and sent to the seller by email no later than within 24 hours. If the buyer discovers the damage only after opening and inspecting the functionality of the goods, the buyer must again contact the carrier and complete a damage report. However, the goods must not be used further, or steps must be taken to prevent further or more serious damage, and all packaging must be preserved.
The goods are considered delivered at the moment of personal collection or at the moment they are collected by the transport company. Upon receiving the goods, the buyer also always receives a tax document and, if applicable, a warranty certificate.
During the Christmas period, delays caused by delivery companies should be expected.
– goods that are not in stock – the seller will inform the buyer of this fact via email or phone. They will then agree on the next steps and the delivery conditions, as the delivery of such goods depends on the seller’s specific supplier.
Failure to collect cash-on-delivery by the buyer
All received orders are binding. They can be canceled after a phone or other conversation, provided they have not yet been dispatched to the delivery location. By submitting an order, the buyer agrees to accept the ordered goods and pay the agreed price. The buyer acknowledges that sending an order to the seller qualifies as a proposal to conclude a purchase contract under § 409 et seq. of the Commercial Code, with these Terms and Conditions being an integral part of the purchase contract. In the event of failure to collect the goods, we are forced to recover shipping costs. If the customer does not collect the shipment, they will have to pay a fine equal to the shipping costs. If this fine is not paid within 14 days of the third and final reminder to pay the fine into our account, the damage caused (fine, court, and execution fees) will be pursued through legal and enforcement proceedings. In the case of canceling an uncollected order, the customer is obligated to pay a fine equal to the postage and packaging costs we have already incurred! If the customer does not collect the shipment and does not compensate for the damage caused, they also agree to the publication of their personal information on the debtor’s page, including their name, surname, street, city, and email address.
